DETYA Certified Agreement6. Further Agreements6.1 It is a term of this Agreement that the Secretary may enter into AWAs with employees whose terms and conditions of employment are regulated by this Agreement. Those AWAs may either:
as specified in each AWA. 6.2 In accordance with the Workplace Relations Act 1996, an AWA must be agreed by the employee and employer and approved by the Employment Advocate or Australian Industrial Relations Commission. 7. Closed Agreement 7.1 This Agreement constitutes a closed agreement in settlement of all matters for its duration. The parties agree that for the life of the Agreement, there will be no further claims, except where consistent with the terms of this Agreement. 8. Commencement and Duration 8.1 This Agreement shall come into operation on and from the date on which the Agreement is certified by the AIRC. The nominal expiry date of this Agreement is 30 September 2002. 8.2 Negotiations between the Department and its employees will commence for the replacement to this agreement from 30 June 2002. 9. Legislative Change 9.1 This Agreement may only be varied in accordance with s.170MD of the Workplace Relations Act 1996. 9.2 The parties to this Agreement agree that in the event of changes during the life of this Agreement to legislation, which may require changes to arrangements or requirements, all employees in DETYA and the parties to this Agreement will be consulted on the implementation of those changes.
